Terms of Service

1. Legal Nature Of this Agreement

These Terms and Conditions (“Terms”) constitute a legally binding electronic contract under the Information Technology Act, 2000, read with applicable rules, between the Company and any person or entity accessing or using the Platform (“User”, “you”, “your”).

By clicking “I Agree”, registering, accessing, or using the Platform, you acknowledge that you have read, understood, and unconditionally accepted these Terms.

If you do not agree, do not access or use the Platform.

 

2. Defenitions

  • Platform: The mobile applications and website operated by the Company enabling discovery, listing, quoting, and booking of transportation services.

  • Transporter / Service Provider: Any individual or entity listing vehicles/trucks and offering transportation services.

  • Shipper / Customer / Service Recipient: Any individual or entity posting loads or booking transportation services.

  • Driver: A person engaged or assigned by a Transporter.

  • KYC: Identity and verification documents including photographs, government-issued IDs, vehicle documents, permits, licenses, and any additional verification required by the Company.

  • Quote: A commercial price offer provided by a Transporter.

  • Booking: A confirmed transport request accepted by a Transporter or a Shipper through the Platform.
     

3. Eligibility And Representations

You represent and warrant that:

  • You are at least 18 years of age and competent to contract under Indian law

  • All information provided by you is true, accurate, complete, and lawful;

  • You are legally permitted to offer or procure transportation services;

  • You shall comply with all applicable laws at all times.

  • You have not been previously suspended or removed from the platform for violation of any of the terms and conditions mentioned herein.

 

4. Platform Role And Disclaimer Of Agency

  1. The Platform is a neutral technology intermediary.

  2. The Company:

    • does not provide transportation services

    • does not own or operate vehicles,

    • does not employ drivers,

    • does not act as an agent, broker, carrier, or logistics service provider.

  3. Any transport service is a direct contractual arrangement between the Transporter and the Shipper.

  4. No partnership, joint venture, agency, or employment relationship is created by use of the Platform.

  5. The company does not assume any responsibility for selection, supervision, control or monitoring of transporters, shippers, drivers, or vehicles.
     

5. KYC, Camera Access, and Document Collection

  1. Users expressly consent to:

    • camera access for capturing photographs,

    • uploading identity documents, vehicle documents, vehicle photographs, and related visual verification materials. - should we need to add this?)

  2. KYC data is collected strictly for:

    • identity verification,

    • fraud prevention,

    • regulatory compliance,

    • platform safety and dispute handling.

  3. The Company may store KYC data securely and restrict access on a need-to-know basis.

  4. Submission of false, forged, stolen, or misleading documents shall result in immediate suspension or termination and may invite legal action.

  5. Users confirm that they have lawful authority to upload all documents.

  6. The company does not guarantee the accuracy or authenticity of KYC documents and relies on user representations.

This section complies with the Digital Personal Data Protection Act, 2023, DPDP Rules, and Information Technology (Reasonable Security Practices) Rules.

6. Subscription Plans (No Cancellation)

  1. Access to certain features requires purchase of a subscription plan.

  2. Subscription fees are:

    • payable in advance,

    • non-refundable, and

    • non-cancellable under all circumstances.

  3. No cancellations, chargebacks, or reversals are permitted once a subscription is activated.

  4. The Company reserves the right to revise subscription pricing or features prospectively.

  5. All subscription fees are exclusive of applicable taxes unless stated otherwise.
     

7. Bookings, Quotes, and Commercial Terms

  1. Quotes are provided solely by Transporters.

  2. The Company does not control pricing, acceptance, rejection, or performance.

  3. A Booking is confirmed only upon acceptance by the Transporter or the Shipper.

  4. The Company does not guarantee payment, settlement, or recovery of any amounts between users.

  5. The Company bears no responsibility for:

    • delays,

    • non-performance,

    • disputes,

    • payment failures,

    • damages or losses.
       

8. Driver and Vehicle Responsibility

  1. Transporters are solely responsible for:

    • driver background verification,

    • valid driving licenses,

    • vehicle permits, insurance, fitness,

    • conduct and behavior of drivers.

  2. The Company does not verify driver criminal records or behavioral history.

  3. Any misconduct, accident, injury, or loss involving a driver or vehicle shall be solely the responsibility of the transporter.
     

9. Ratings and Reviews

  1. Users may submit ratings and reviews based on genuine experiences.

  2. Prohibited content includes:

    • defamatory or abusive language,

    • false or misleading reviews,

    • personal data disclosure,

    • harassment or threats.

  3. The Company reserves the absolute right to:

    • remove reviews,

    • suspend accounts,

    • restrict platform access.

  4. Reviews are user-generated content; the Company does not endorse or verify the accuracy of any review or rating; the assumes no liability in this regard.
     

10. Prohibited Conduct

Users shall not:

  • submit fake KYC,

  • impersonate any person,

  • transport illegal or restricted goods,

  • misuse platform communications,

  • attempt unauthorized access,

  • upload malware or harmful content.

  • Use the platform for money laundering, terror financing or benami transactions.
     

11. Suspension and Termination

The Company may suspend or terminate access temporarily or permanently without notice if:

  • there is a breach of these Terms,

  • KYC is fraudulent,

  • conduct is unlawful or harmful,

  • required by law or authority.

Termination does not limit the Company’s legal remedies.

 

12. Disclaimer Of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including fitness for purpose, accuracy, reliability, or availability.

13. Limitation Of Liability

To the maximum extent permitted by law:

  1. The Company shall not be liable for indirect, incidental, consequential, or punitive damages.

  2. Aggregate liability, if any, shall be limited to the subscription fees paid in the preceding three (3) months or INR 1,000, whichever is lower.
     

14. Idemdity

Users agree to indemnify and hold harmless the Company from all claims, losses, damages, liabilities, penalties, and legal costs arising from:

  • breach of these Terms

  • illegal acts,

  • false KYC,

  • disputes between users

  • driver or vehicle misconduct.

  • Violation of any applicable law or regulation
     

15. Governing Law and Dispute Resolution

  1. These Terms are governed by the laws of India.

  2. All disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996.

  3. Courts at [City, State] shall have exclusive jurisdiction for interim relief.
     

16. Force Majeure

The Company shall not be liable for failure or delay due to events beyond reasonable control including natural disasters, system failures, government actions, or network outages.

 

17. Miscellaneous

  • Severability: Invalid provisions shall not affect remaining Terms.

  • Waiver: Failure to enforce shall not constitute waiver.

  • Entire Agreement: These Terms constitute the entire agreement.

  • Assignment: Users shall not assign their rights or obligations without prior written consent of the Company.

18. Terms Of Servide Update

From time to time, we may update these Terms Of Service to reflect changes in our services, business practices, or legal obligations.

When we do, we will update the “Last Updated” date and may notify you through the App or other reasonable means. By continuing to use the App after the update, you agree to the revised Terms.

Material changes shall not apply retrospectively to existing disputes.
 

19. Grievance Redressal
